Any chance either pair of the 38's left from the sale come up smaller than tagged in the waist?
No, i'm afraid not. If anything they're slightly bigger than tag, sorry.

They are indeed. 35 inches at the waist.

Just picket these up from customs this morning, after I was able to find one in my size in Japan.
My wife hates it.
Says the legs are to wide and the stacking is meh.I like them and think once the fabric has relaxed a little they'll look cool.
